Working as an of counsel at Franklin Soto LLP, Dean T. Kirby Jr. provides legal representation to clients in San Diego, California. His primary focus is on assisting lenders, landlords, creditors, and fiduciaries in matters related to bankruptcy, foreclosure, and commercial collections. His expertise lies in guiding clients through the intricate aspects of these legal proceedings.
Mr. Kirby’s role involves representing lenders in the process of recovering loan obligations either through foreclosure procedures or contested cases within bankruptcy proceedings. He also aids creditors in safeguarding funds and assets received before the initiation of bankruptcy petitions. This encompasses the defense against legal actions such as “avoidable transfer” lawsuits filed by bankruptcy trustees. Moreover, he assists both borrowers and lenders in documenting loans that are backed by real estate or personal property. He also assists parties interested in acquiring assets from individuals undergoing bankruptcy. Notably, he does not provide representation to consumers acting as debtors in bankruptcy or those involved in foreclosure disputes.
Having graduated from the University of Nebraska–Lincoln in 1976, Mr. Kirby furthered his education at the University of California, Berkeley School of Law (Boalt Hall), where he served as an associate editor for the California Law Review and obtained his Juris Doctor degree in 1979.
Throughout his career, Mr. Kirby has served as legal counsel for court-appointed receivers, bankruptcy trustees, official creditor committees, and has held positions such as Chapter 11 trustee and examiner. His expertise in bankruptcy law is certified by the California Board of Legal Specialization, and he holds a separate certification in creditors’ rights from The American Board of Certification. Remarkably, he is one of just two California attorneys to hold both of these certifications concurrently. His commitment to ethical legal practices and exceptional skills have led to him receiving an AV Preeminent* peer-review rating from Martindale-Hubbell, along with a perfect 10.0 rating on Avvo.
