For the past 25 years, Eric B. Fastiff has been deeply involved in the realm of commercial litigation, handling a diverse array of cases spanning industries such as pharmaceuticals, food, technology, finance, and natural resources. His legal expertise extends to resolving commercial disputes for businesses, whether they involve suppliers or competitors. His clientele is broad and encompasses governments, Native American tribes, their healthcare providers, businesses, individuals, and consumer advocacy groups.
Presently, Eric is dedicated to representing multiple Native American tribes and healthcare providers who are pursuing compensation for the hardships they endured during the Opioids and Juul epidemics.
One of Eric’s prominent roles was as co-lead counsel in the California Cipro litigation, wherein he represented California consumers and third-party payors in a state-level class action lawsuit against Bayer, Barr Labs, and other manufacturers of the generic prescription drug Ciprofloxacin. The lawsuit accused them of conspiring to restrict competition in the sales of Bayer’s widely used antibiotic, Ciprofloxacin (Cipro). The litigation, spanning 17 years, ultimately led to settlements amounting to $399 million, a remarkable outcome lauded by the trial court as “extraordinary.” This accomplishment garnered recognition for Eric and the LCHB team, who were named 2016 California Lawyers of the Year by California Lawyer and the Daily Journal. Additionally, they were honored with the American Antitrust Institute’s 2017 award for Outstanding Private Practice Antitrust Achievement.
Furthermore, Eric is actively involved in representing The Charles Schwab Corporation in a lawsuit against several major banks, alleging manipulation of the London Interbank Offered Rate (LIBOR). He has also successfully overseen the prosecution of a two-week arbitration on behalf of a client, addressing both intellectual property and breach of contract claims.
Eric’s track record boasts notable successes, including his representation of businesses in litigation concerning TFT-LCD panels and products. This legal action centered on allegations that leading manufacturers of TFT-LCD panels conspired to fix prices. The litigation concluded with settlements surpassing $470 million.
